5) DELIVERIES

Products ordered on the OJA ATELIERS website are delivered within the timeframe indicated on the website at the time of order confirmation. These timeframes are indicative only and correspond to the average processing and delivery time of the package.

It is the customer's responsibility to check the condition of the package upon delivery and to make any justified claims if the package appears to have been damaged.
An open or incomplete package must not be accepted by the customer. Clearly and precisely note any reservations on the delivery slip.

Products can be shipped worldwide. OJA ATELIERS cannot ship to hotel addresses or P.O. boxes.

OJA ATELIERS delivers orders within a maximum of 7 business days in Metropolitan France and a maximum of 15 business days internationally. This delivery time is calculated from the day after the order is validated.

Following the launch of our new products or during the Christmas period, the delivery time may be extended by 10 days so that OJA ATELIERS can have the necessary time to prepare your orders.

Any change of address by the customer after validation of an order will result in a delivery delay, which the customer acknowledges and accepts.

Our official carrier is DHL EXPRESS in metropolitan France and internationally.

OJA ATELIERS and the carrier being separate and independent entities, OJA ATELIERS cannot be held responsible for any delay and error in delivery or loss of parcel attributable to DHL EXPRESS.

Delivery of products is taken care of by OJA ATELIERS for purchases of €750 or more for residents of Metropolitan France.

Delivery is at the customer's expense and according to the carrier rates in effect and offered by the site at the time of purchase if the delivery location is not in the aforementioned country(ies).

6) RIGHT OF WITHDRAWAL AND RETURN PROCEDURES

In accordance with Article L.221-18 of the French Consumer Code, the customer has a withdrawal period of 14 clear days from the date of receipt of their order to exercise their legal right of withdrawal.

The customer may return one or more items from said order to OJA ATELIERS.

The customer is responsible for return shipping costs and risks. The customer acknowledges that additional customs fees related to returning a product from abroad may be charged to the customer.

OJA ATELIERS recommends carefully tracking your return package and encourages you to keep solid proof of shipment (preferably with tracking). You may choose your preferred carrier. OJA ATELIERS does not accept packages or mail sent with postage due.

Items returned by the customer must be new, unused, and in perfect condition. Items must be returned in sturdy, protective packaging, accompanied by a copy of the invoice and the original warranty received at the time of purchase.

If the item is returned in unprotected packaging and is damaged, OJA ATELIERS will not issue a refund. Failure to comply with these return conditions will result in the package being returned to the customer at their expense and no refund will be issued.

Upon receipt of the returned order, the seller will issue a refund, excluding initial shipping costs (within 15 days).

The customer must indicate the reasons for the return by email to bonjour@oja-ateliers.com .

Unless otherwise indicated by the customer, the refund will be made to the same payment method used for the initial order payment.

It is not possible to replace or exchange returned products. A new order will need to be placed.

Return shipping costs are covered by OJA ATELIERS if the product delivered to the customer is different from the product ordered.

 

7) GUARANTEES

The products offered by OJA ATELIERS benefit from the legal guarantees of conformity and hidden defects.

Improper use of the products and any related consequences are not covered by the contractual warranties. OJA ATELIERS' liability is limited to the purchase price of products bought on the website.

In addition to the legal guarantee of conformity, OJA ATELIERS offers a commercial guarantee as detailed below:

OJA ATELIERS takes the utmost care to ensure the quality of its products and offers a commercial guarantee valid for 1 year following the purchase.

The warranty applies only if the use of the product is deemed normal by the OJA ATELIERS workshops.

The commercial warranty does not apply in the event of aging, alteration due to the use of perfume, cream or any other product which may damage the product, wear and tear, breakage or loss due to an accidental cause, intervention by a third party, improper use, lack of maintenance or finally damage caused during transport engaging the responsibility of the carrier.

After verification of the product and the validity of the warranty, the warranty includes free repair of the product, subject to parts availability. If the product cannot be repaired, OJA ATELIERS will exchange the product (subject to stock availability) or issue a credit note for a product of similar value.

This guarantee is subject to the customer presenting the purchase invoice and the initial guarantee received at the time of purchase.

 

8) PERSONAL DATA

Your customer account information is used only within the context of your business relationship with www.oja-ateliers.com

Under no circumstances will this personal information be shared with a third party. Your personal information is protected, not resold, and strictly confidential.

9) INTELLECTUAL PROPERTY

The customer acknowledges that the products, texts, photographs, trademarks, graphics, packaging, product names, concepts, illustrations… (etc.) are the exclusive property of OJA ATELIERS and are protected by copyright.

The French language shall prevail for interpretation in the event of translation of the site and the general terms and conditions of sale.

The general terms and conditions of sale of OJA ATELIERS are subject to French law and applied and interpreted in accordance with that law.

The customer and the seller declare that the general terms and conditions of sale express the entirety of their agreement with respect to their subject matter, and that they cancel and replace all previous agreements between them relating to that subject matter.

Any damage caused to the customer due to the use of our site does not entail the liability of OJA ATELIERS beyond the amount of the order paid by the customer.

Any dispute arising from the interpretation of these general terms and conditions of sale shall be subject to the jurisdiction of the courts of Paris.
